PUBLISHING TERMS & ROYALTY DISTRIBUTION POLICY

1. INTRODUCTION

Hankad Music Publishing provides professional music publishing administration services to artists, songwriters, and rights holders. By entering into an agreement with Hankad, you grant us the right to collect and administer publishing royalties on your behalf. This document outlines the terms, revenue split, and royalty distribution process.

2. RIGHTS GRANTED TO HANKAD

By signing a publishing agreement with Hankad, you grant us the non-exclusive right to:

  • Register your compositions with Performing Rights Organizations (PROs), Collective Management Organizations (CMOs), and other relevant rights management entities.

  • Collect performance, mechanical, and synchronization royalties from various sources worldwide.

  • License your music for synchronization (TV, film, commercials, video games, etc.), subject to approval where necessary.

  • Sub-publish your works in various territories through our international partnerships.

3. ROYALTY SPLIT

Hankad will retain 40% of the publishing royalties, and you (the songwriter/composer) will receive 60%. This applies to all royalties collected, including:

  • Performance Royalties – Collected from PROs and CMOs for public performances (radio, TV, live events, streaming, etc.).

  • Mechanical Royalties – Generated from the reproduction of your compositions on digital and physical formats (Spotify, Apple Music, CDs, etc.).

  • Sync Royalties – Earnings from placements in film, TV, ads, and games.

  • Print Royalties – Revenue from the sale of sheet music (if applicable).

4. ROYALTY DISTRIBUTION SCHEDULE

Hankad will distribute royalties every quarter (every three months). However, the first royalty distribution can take up to 12 months due to the processing time of different rights organizations and collection agencies.

  • Quarterly Payouts:

    • Q1: January – March (Payout in June)

    • Q2: April – June (Payout in September)

    • Q3: July – September (Payout in December)

    • Q4: October – December (Payout in March of the following year)

  • The delay in the first royalty payment is due to the time required for PROs, CMOs, and digital platforms to process and deliver earnings.

  • Minimum payout threshold: €50 (If your balance is below this, it rolls over to the next quarter.)

5. SYNC LICENSING TERMS

  • Hankad will actively pitch your music for synchronization opportunities.

  • Sync fees (upfront licensing fees) are split 50/50 between you and Hankad.

  • You have the right to approve or decline sync deals for your music unless a pre-approval clause is agreed upon.

6. REGISTRATION & ADMINISTRATION

  • Hankad will register your compositions with major PROs and CMOs worldwide, including ASCAP, BMI, PRS, GEMA, SACEM, and others.

  • You are responsible for providing accurate metadata, including ISWC codes, co-writer information, and ownership splits.

  • Incomplete or inaccurate metadata may lead to delays or loss of royalties.

7. TERMINATION OF AGREEMENT

  • The agreement is valid for a minimum period of 12 months, after which you may terminate with a 90-day written notice.

  • If you terminate, Hankad retains the right to collect any outstanding royalties earned during the agreement period.

  • Fraudulent activity or misrepresentation of rights will result in immediate termination and potential legal action.

8. TAX & PAYMENT DETAILS

  • Hankad may be required to withhold taxes as per the laws of your country.

  • You must provide valid payment details (Bank, PayPal, or Mobile Money) and tax identification information.

  • Any fees related to bank transfers or payment processing will be deducted from your royalties.

9. REPRESENTATIONS & WARRANTIES

By signing with Hankad, you confirm that:

  • You are the rightful owner or authorized representative of the compositions submitted.

  • Your music does not infringe on any third-party rights.

  • You have not assigned exclusive rights to another publisher that conflicts with this agreement.
